Scouter99 Posted June 19, 2014 Share Posted June 19, 2014 The line on the federal law requiring proof of age is images taken after 1996 (or something like that, its US Code 2257 but I don't really care to do a lot of Googling down that line), and whether the photo is sexually explicit. A 15 yr old girl sending out photos of herself to elicit a sexual response is illegal because it is pornography and she's the one that created and transmitted. A funny baby photo is not. A funny baby photo is not.[/quote'] Unfortunately, the baby photo can still get you investigated by the police, and your children temporary removed by child services. Just because naked baby pictures aren't illegal, doesn't mean you won't have a huge and expensive mess on your hands. A few years ago there was a news story about a local man that had a couple of naked baby pictures of his son on his phone, he got detained at the Canadian border for smuggling kiddy porn. He was denied entry, was separated from his family and bared from the country until his court date. I don't know what finally happened with the whole thing.
