Insurers have filed three motions listed below to compel the Coalition and Abused Scouting (AIS) and its representing law firms -Kosnoff Law, and Ichor Consulting to submit the disclosures required by the Federal Rule of Bankruptcy Procedure 2019. Not sure if legal firms AVA Law Group and Eisenberg, Rothweiler are still in the Coalition. IMHO, the Coalition appears a ball of confusion as to who is who...are you in or are you out. Remember before August when victims were represented by one committee – the TCC (Torts Claimants Committee)? Objection Deadline Feb 10, 2021. Hearing is requested for Feb 17, 2021. Federal Rule of Bankruptcy Procedure 2019: My layman understanding, under Procedure 2019 committees (e.g. Coalition) consisting of lawyers(etc.), multiple creditors (victims) or equity security holders must disclose the identity of each member and the “disclosable economic interests” (claims) in the debtor (BSA). If a committee does not comply, “the bankruptcy court may refuse to permit the entity, group or committee to be heard or to intervene in the case, hold invalid any authority, acceptance, rejection, or objection given, procured, or received by the entity, group or committee, or grant other appropriate relief. “ Research Refererences I used: https://content.next.westlaw.com/Glossary/PracticalLaw/I2104dddbef0811e28578f7ccc38dcbee?transitionType=Default&contextData=(sc.Default)&firstPage=true https://www.olshanlaw.com/resources-alerts-21.html Three motions 2028,2029.2030: https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/872684_2028.pdf Hartford Accident and Indemnity Company, First State Insurance Company and Twin City Fire Insurance Company → Coalition of Abused in Scouting (AIS), Kosnoff Law - 247 pages. Yowser, how do you really feel about Kosnoff. Alarming quotes and tweets from Kosnoff. Questions which law firms are actually in the Coalition. A lot in here. https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/872697_2029.pdf Century Indemnity (CCI Insurance)→ J.Chad Edwards, Ichor Consulting, LLC - 26 pages, pdf is messy, some questions regarding legal background and virtual office. - Exhibit A Proposed Order extract (page 5,6) Ichor Consulting LLC and J. Chad Edwards must produce the following information pursuant to Rule 2019: A. A list of the names and addresses of all creditors (including creditors for whom the filing counsel is acting as co-counsel), and a general statement about the nature of their respective claims and when those claims arose. B. A complete copy of each form of retainer agreement, fee agreement, engagement agreement, referral agreement and other agreements authorizing Ichor Consulting, LLC and Mr. Edwards to act on behalf of a creditor in this case, consenting to the payment of Ichor Consulting, LLC’s and Mr. Edwards’ fees and costs and their representation of multiple parties, including all amendments and modification to any such agreements. C. A list and explanation of any co-counsel, consultant, or fee-sharing relationships and arrangements in connection with this bankruptcy case or claims against any of the Debtors, and attachment of copies of any documents that were signed in conjunction with creating that relationship or arrangement. D. All other information and disclosures required by Fed. R. Bankr. Particularly recommend Preliminary Statement (pages 1-5) and Statement of Facts (pages 5-14). - Exhibit A Proposed Order extract (page 27) Abused in Scouting and Kosnoff Law PLLC must separately produce the following information pursuant to Rule 2019: A. A list of the names and addresses of all creditors (including creditors for whom the filing counsel is acting as co-counsel) represented by Abused in Scouting and Kosnoff Law PLLC. The list should indicate whether each creditor has opted in to be part of the Coalition B. A complete copy of each form of agreements authorizing Abused in Scouting and Kosnoff Law PLLC/Tim Kosnoff to act on behalf of a creditor in this case and their representation of multiple parties. C. A list and explanation of any co-counsel, consultant, or fee-sharing relationships and arrangements in connection with this bankruptcy case or claims against any of the Debtors, and attachment of copies of any documents that were signed in conjunction with creating that relationship or arrangement. D. A list of the persons or entities with an equity interest in the claims of any creditor represented by Abused in Scouting and Kosnoff Law PLLC/Tim Kosnoff other than the claimant. E. All other information and disclosures required by Fed. R. Bankr. P. 2019. The Coalition must produce the following information pursuant to Rule 2019: A. A list of the names and addresses of all creditors represented by the Coalition, including the law firm that represents each creditor. The list should indicate whether each creditor represented by Abused in Scouting and/or Kosnoff Law PLLC/Tim Kosnoff has opted in to be part of the Coalition. B. A list of the persons or entities with an equity interest in the claims of any creditor represented by the Coalition other than the claimant. C. All other information and disclosures required by Fed. In a Feb 2, letter “At this time, all Cub Scout and Boy Scout groups, whose charters are held by Catholic Schools or Parishes within the Archdiocese of New Orleans, should cease all scouting activities until further notice.” ... ”Boy Scouts of America has updated the language of their Charter Agreement. Our legal team, along with our insurers, are in dialogue with BSA and are awaiting clarification of the new language, and risks to which our groups may be exposed. This is a complex issue.” The letter also informed units which have not signed their rechartering documents to not do so until further notice. ...“As of January 31, 2021 the charters of the Boy Scout Chapters held at parishes and schools in the Archdiocese of New Orleans expired and shortly the insurance provided to Charter Holders, which is not provided through the archdiocese, will also expire. We recognize and strongly value the importance of Scouting to our youth. Archdiocesan leadership is actively pursuing clarifications on the changes in obligations and expectations of the 2021-2022 Charter Agreement, as well as insurance coverages that may be provided beginning March 1, 2021 to Chartering organizations, while considering alternative actions that will enable scouting to remain a vibrant and active part of the community in our parishes and schools.” more at source https://www.fox8live.com/2021/02/03/some-boy-scout-leaders-new-orleans-area-told-they-have-stop-all-activities-until-further-notice/

IMHO this became a foregone conclusion back in June/July when the Court required that Councils provide asset lists and subsequently when both parties hired assessors. Add to that the filing extension date for victims. As I understand, after almost a year, the Court has not formally ruled whether local councils are legally separate business entities nor has it resolved key insurance company liability issues meanwhile validation of victim claims continues. Given the volume of legal work ahead, it would be helpful to our program and scouts if the Judge ruled, say on Feb 18, 2021, that our 2021 summer camps will not be impacted by ongoing Chapter 11. National lawyers should make that request during Scout Week. My $0.02,

IMHO, here is a Council that understands their local summer camp planning has a higher priority and purpose than the National-driven endless restructuring. “We have a very good group of volunteers and staff that, this is really their one, main priority right now, is to make sure that we can hold camp and we can hold it in a safe manner for everyone,” Hawkeye Area Council (Iowa) CEO Sarah Dawson said. ... “We are designing plans A, B, C, D, through about Z right now to make sure that we have — we’re looking at all options, and no matter what happens and what stage we’re at, that we’ll still be able to hold things safely,” Dawson said. https://www.kcrg.com/2021/01/25/hawkeye-area-council-to-resume-scout-camps-this-summer-adding-sessions-for-non-scouts/

In a day full of history making achievements for women and people of color, Boy Scout Troop 358 (PA) played its own critical role in the inauguration of 46th President Joe Biden and Madam Vice President Kamala Harris. "This year we knew it was going to be virtual, so we felt safe about applying. We applied and waited and we had to film a video. We filmed it at the Art Museum, something to represent the Commonwealth of Pennsylvania and the city of Philadelphia and the Boy Scouts and the church," explained Wallace. And, the video will now be seen all over the country, throughout Inauguration Day, with Troop 358 running up the iconic Rocky steps to showcase Philadelphia’s youth to the nation. ... my search was easier but for an Underwood No. 5 which predated ASCII and digital computers for that matter. Typed my Eagle Project write-up (two pages, double space). As I recall the we punched IBM cards with either the IBM 026 or 029. The fun feature with 029 was duplicating a pre-punched card. It sounded like a machine gun, well a Mattel machine gun. But I digress...

There has been no agreement as to what is minimally required to allow the BSA to continue to operate/function and I would further say the sides are far apart. After nearly a year of Chapter 11: 1. There are ongoing asset evaluations by both sides , however, there has been no ruling whether local Council assets are on the table. 2. Insurance responsibility (payouts) remains a question. 3. There is a complete creditor list (guess who is at top of the list) 4. There is a bounded victim list (95,000 which is far more than estimated) though not yet verified. 5. As I recall, the BSA has a May deadline to present their restructuring plan to the Court. As to the disposition of BSA pensions and health plans in this bankruptcy, that remains to be seen. https://www.irs.gov/retirement-plans/plan-participant-employee/retirement-topics-bankruptcy-of-employer https://www.dol.gov/sites/dolgov/files/ebsa/about-ebsa/our-activities/resource-center/fact-sheets/your-employers-bankruptcy.pdf https://today.westlaw.com/Document/Ie0435490521211ebb50ccd189a1f9b53/View/FullText.html?contextData=(sc.Default)&transitionType=Default&firstPage=true My $0.01 for rambling,

Please correct me if I am wrong, this will be the first Presidential Inauguration since 1913 where no Boy Scouts will participate? President-elect Joe Biden was a Boy Scout. https://blog.scoutingmagazine.org/2016/05/19/vice-president-joe-biden-a-former-scout-says-scouting-teaches-valuable-life-lessons/ https://blog.scoutingmagazine.org/2017/01/17/scouts-and-presidential-inaugurations-have-a-long-interesting-past/

IMHO, let's discuss the new transparent explanation of proposed Council spending and how it is approved before discussing any new means of funding it.

I understand the cost issue, but it is helpful maybe even required in their job hunt for scouts (and scouters) to have business recognized first aid certifications from the American Heart Association, American Red Cross, SOLO, NOLS.- 96 replies

POLICY CHANGE, Diversity and Inclusion MB
RememberSchiff replied to John-in-KC's topic in Advancement Resources
IMO, 1972, 1999 was a return to choice. In some cases, a scout could select a preferred "required" merit badge from a subject groups as I did back in the day. At my EBOR, I would have answered that Lifesaving was most important as I was a lifeguard and rescued a few people. Today, I might say Public Health. Would I have First Aid, Swimming, Personal Fitness, Cooking merit badges? Nope. First Aid should be a yearly re-certification with each year requiring more skills. Every FC scout should be strong swimmer, physically strong, and a passable patrol cook. What groups for Eagle required merit badges? Hmmm, one or two from each group- a few required but most scouts select. Emergencies: Emergency Preparedness, Search and Rescue, Fire Safety, Lifesaving Outdoor: Camping, Backpacking, Hiking, Wilderness Survival, Orienteering, Pioneering, Canoeing, Kayaking,... Health (well-being): Safety (add tool safety), Public Health, Medicine, Disabilities Awareness Personal Finance: Personal Finance Citizenship: focus on responsibilities and rights. Service, voting, petition, remedies. Interaction with government particularly police.. Environment: Fish&Wildlife Management, Forestry, Environment Science (ugh), Sustainability (ugher), Soil & Water, Nature Maker skills : Cooking ( as in make family dinner! ), Home Repair, Woodwork, Robotics. Dradting (CAD, Wood carving, Electricity, Plumbing... OR Science: Chemistry, Engineering, Architecture, Aviation my $0.01 for rambling- 96 replies

Update on new Diversity, Equity, and Inclusion MB
RememberSchiff replied to CynicalScouter's topic in Advancement Resources
IMHO, Councils should be scrambling to deliver their summer camp 2021. Otherwise Councils will meet the above percentage quotas of new demographics by default that is, by losing existing demographics. Meeting new Churchill membership metrics by losing existing members, what a thought. Another diversion from National? -

Agree, consider this recent story, does it really matter if these girls who are scouts are GSUSA or Scouts,BSA Troop 222 "girl scouts".
