The TCC Status Report the Tort Claimants’ Committee and FCR were left with no alternative but to file the Standing Motion. (regarding J.P. Morgan settlement) Absent a mediated resolution and in light of the Debtors’ proposed Plan that does not propose any compromise of the issues in the Restricted Property Action or the mediation brief, the Tort Claimants’ Committee will press forward with the Restricted Property Action. (a lot of issues regarding LC's participation, cooperation, representation...) The Tort Claimants’ Committee has reviewed substantially all of the assets and liabilities of the Local Councils and determined that they could collectively contribute multiples of the aspirational $300 million amount while at the same time continuing to operate in the ordinary course of business..(then next paragraph complains that Debtor did not provide that information to survivors) Third, the Disclosure Statement does not present any financial information about the Local Councils, either collectively or individually. Absent disclosure of the fair market value of the Local Council assets and liabilities, no abuse survivor will be able to determine if the value he will receive under the Plan will satisfy ... Fourth, there is no disclosure regarding what each Local Council proposes to contribute in exchange for its release. (ditto CO's...) All of the issues with the Local Councils’ participation are same with the Chartered Organizations except there is absolutely no information about what any of the Chartered Organizations might be willing to contribute. While two major religious organizations are mediation parties, they have not filed any mediation briefs or attempted to engage the Tort Claimants’ Committee in any mediation. (concludes...) Regardless of the rosy picture the Debtors try to portray, there is a substantial amount of work to be done and in many instances much of that work apparently has not yet begun. Given the current state of the proposed Plan and Disclosure Statement and the host of unresolved issues, Debtors cannot reasonably expect approval of their Disclosure Statement less than a month from now. https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/881136_2388.pdf

Forest fire started at Camp Tuckahoe (PA)

New Birth of Freedom Council statement: Status of Camp Tuckahoe After Brush Fire on March 14 To our Scouting community: We are sad to report that a brush fire occurred at Camp Tuckahoe on Sunday evening while the property was vacant. We are immensely grateful for the quick response of area fire departments whose efforts contained the fire early Monday morning and saved all buildings from damage. As many of you know, we closed Camp Tuckahoe beginning in October to enable the removal of unhealthy and unstable trees to protect the health and safety of all camp attendees. As part of this effort, groups of dedicated volunteers and employees have given their time on several Saturdays to help carefully remove debris caused by this process, which has included burning some of the material. While the burn pile was thought to have been fully extinguished, it appears that embers reignited some time on Sunday and unfortunately caused this fire. This incident offers a stark reminder about the importance of fire safety, staying vigilant, and triple-checking each area to ensure a fire is out cold and the area is cool to the touch before leaving. We are committed to reviewing this incident, learning from it, and working to ensure that nothing like it happens again. It will take some time to fully assess the situation, but we are grateful to share that the majority of Camp Tuckahoe’s main program areas were not impacted by the fire. At this time, we believe we can still provide our members and communities with the summer programs that Camp Tuckahoe is known for starting in June. We will continue to provide updates to our Scouting community as the situation develops. Thank you for your participation in Scouting and ongoing support as we navigate this challenge and prepare for a safe summer filled with fun and adventure. We look forward to seeing everyone at camp. Yours in Scouting, William F. McQuade Council President Thomas A. Steckbeck Council Commissioner Ronald M. Gardner, Jr. Scout Executive https://newbirthoffreedom.org/2021/03/15/status-of-camp-tuckahoe-after-brush-fire-on-march-14/ -

Agreed, I am shaking my head. Do we tear the corner of their Firem'n Chit card for failing Item 7? 7. I will use the cold-out test to make sure the fire is cold out and will make sure the fire lay is cleaned before I leave it. Oh right, these were volunteers and employees. https://www.scouting.org/awards/awards-central/firemn-chit/ Wonder what the financial and operational consequences will be for Council? Neighbors aren't happy when you burn their property. -
Forest fire started at Camp Tuckahoe (PA)

A forest fire was set off accidentally at Camp Tuckahoe in York County, PA. Ronald Gardner, Jr., CEO and Scout Executive of the Boy Scouts’ New Birth of Freedom Council, said debris was burned by volunteers and employees during work at the camp . "However, it appears that embers reignited some time on Sunday and unfortunately caused this fire,” he said. And so will scouting, even after the crisis.

Speaking of which, has the 2021 BSA Report to the Nation been delivered to Congress? 36 U.S. Code § 30908 Annual Report Not later than April 1 of each year, the corporation shall submit a report to Congress on the activities of the corporation during the prior calendar year. Recall last year 2020 https://blog.scoutingmagazine.org/2020/02/28/these-13-outstanding-scouts-will-deliver-the-bsas-report-to-the-nation/

Yes, these lifeboat councils could blame the sinking BSA and I wouldn't be surprised if the criticism came directly from newly hired, former National employees, but those councils might survive. Just thinking out loud as to options.
-
Could the Debtor (the BSA) reject Council franchise agreements in SOL states (twenty I believe)?
-
Good point.
-
Local council camps have been sold since the BSA has entered Chapter 11. Whether all transactions complied with whatever Court guidelines that were set is a question. It does appear those guidelines or enforcement needed a boost.

Can we return to the topic at hand, Chapter 11? Thanks, @MattR @John-in-KC RS

On January 24, Nathaniel Ware, an honor roll student at Narragansett Regional, placed third in the 2021 Massachusetts Civilian Marksmanship Program (CMP) 3 Position (standing, kneeling and prone) Air Rifle (3PAR) State Championships. On Feb. 13, Ware again placed third, this time in the 2021 Massachusetts State Junior Olympic 3PAR Championships. .. Not too shabby for a young man who was introduced to the sport as a 12-year-old by the Boy Scouts of America. “I’ve loved shooting from the first time I tried it back in the Boy Scouts; it’s a lot of fun,” Ware said. “So, since it’s fun and I’m good at it, I decided to stick with it. Ever since I first picked up a rifle, I’ve been getting very high scores, even though I had never shot before.” Much more at source: https://www.thegardnernews.com/story/sports/2021/03/02/templeton-resident-nathaniel-ware-making-his-mark-sport-competitive-air-rifle-shooting/6876741002/

Note: When members mention "executive" pay, they are referring to paid executives not volunteers, for example, from Form 990 (2019)

Mar 9: "The committee representing child sex abuse survivors in the Boy Scouts of America bankruptcy case has agreed to the extension (to July 19) of an injunction halting lawsuits against local Boy Scouts councils and sponsoring organizations. In return for the extension, the BSA and local councils must provide the committee with information about local troop rosters that can help victims validate their claims, according to a court filing submitted Monday." Perhaps something like this will be part of the non-monetary settlement terms. Lest we forget. Consider Docket 1881 from December. DEBTORS’ MOTION FOR ENTRY OF AN ORDER (I) APPROVING HENDERSON SETTLEMENT AGREEMENT AND (II) MODIFYING THE AUTOMATIC STAY, TO THE EXTENT NECESSARY, TO PERMIT PAYMENT OF SETTLEMENT AMOUNT BY APPLICABLE INSURANCE and the Safety Moment website posting that the BSA was required to do. Defendants further agree that, within a reasonable time after the Effective Date (not to exceed seven (7) days) the BSA shall post the Safety Moment attached as Exhibit A, on the BSA website. In exchange for payment of the Settlement Amount and the above-described non-monetary provisions, the Plaintiff agrees to dismiss the Lawsuit with prejudice and without costs and provide the releases set forth below. BSA website posting. https://www.scouting.org/health-and-safety/safety-moments/fatal-fall-nolans-story/ Docket 1881 reference Pages 17 and 24 https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/867561_1881.pdf I found these other cases: https://www.scouting.org/health-and-safety/safety-moments/dangers-of-leaving-scouts-unsupervised-sand-dunes-and-digging-in-sand-dunes-gages-story/ https://www.scouting.org/health-and-safety/safety-moments/hazard-trees-and-hammocks-jacks-story/ https://www.scouting.org/health-and-safety/safety-moments/roadside-fatality-austins-story/ Also of note: https://www.scouting.org/health-and-safety/safety-moments/shooting-sports/ Another $0.02,

On the topic of YP quality, I would like Council to summary report on safety (including YP) incidents and actions of past year at recharter and during training. Not necessarily names or units unless publicly reported. Doesn't have to be at the production level of Frank Capra Why We Fight but same idea. My $0.02,
