  3. Oct 14, 2021 For comparison: A federal bankruptcy court in Minnesota has accepted a reorganization plan that would compensate sexual abuse survivors in the Diocese of Winona-Rochester. The U.S. Bankruptcy Court for the District of Minnesota signed off on the plan on Thursday after it was submitted by the diocese and the Committee of Unsecured Creditors, who represent the 145 abuse survivors. The diocese and committee reached a settlement in February for $21.5 million. Terms of the plan confirmed Thursday by the court call for the creation of a trust fund totaling just over $22,000,000 to compensate the survivors. It covers Diocesan assets, including the disposition of specific Diocesan assets and insurance coverage settlements of $6.5 million. The diocese filed Chapter 11 bankruptcy in November 2018. Since then, the diocese said it's been working toward a resolution of claims against the diocese and non-diocesan Catholic entities within the diocese. The statement from the diocese said the plan also includes the "implementation of enhanced non-monetary protocols for the protection of children which were first implemented by the diocese in 2002. 4. Yes. You're right. My source. Plan 5.0 https://casedocs.omniagentsolutions.com/cmsvol2/pub_47373/da60d7ce-df85-45e9-9737-4dd1a5d50014_6445.pdf pg 429, total contribution $260,391 Unrestricted Net Assets $417,106 ...so I assumed the difference was the value of the unsold council property which I assumed unrestricted. I missed page 345, for Chief Cornplanter Council as of Feb 28,2021 Assets Cash & Equivalents $ 105.349 Land, Buildings, and Equipment 182.408 Long-Term Investments 957,394 Other Assets 154,223 Total Assets 1,399,374 Liabilities Debt Other Liabilities 33,515 Total Liabilities 33,515 Unrestricted Net Assets 417,106 Restricted Net Assets 948,753 Total Net Assets 1,365,859 I also missed page 363 Chief Cornplanter Camp Olmsted Fair Market Value $784,000 (assessed by CBRE) which must part of Restricted Net Assets above. "Camp Olmsted is located just 15 miles north of Warren, in the beautiful scenic mountains of the Allegheny National Forest in Northwestern Pennsylvania. It includes: 485 acres of natural woodlands, three miles of waterfront with access to the 24-mile long Allegheny Reservoir lake that was created in the summer of 1967. The lake has 91 miles of shoreline, primarily unspoiled, which allows for limitless water-skiing, motor boating and sailing usage." https://www.waymarking.com/waymarks/wm13Q8X_Camp_Olmsted_Chief_Cornplanter_Council_Russell_Pennsylvania Good catch. My error.
  5. Yes. It is a word problem worthy of the SAT. Two Pennsylvania councils that serve parts of New Jersey with total assets of $23 million. John Lucas, the (TCC) panel's bankruptcy attorney, says New Jersey's share of the settlement alone should be closer to $44 million and with the two Pennsylvania councils should total $58 million so the two PA councils new TCC proposed total is 58-44 million = $14 million 14 / 23
  6. By his math, NJ councils 78.6%, 2 PA councils that serve NJ 61%.
  7. The Chief Cornplanter Council (PA) will pay their total trust contribution $260,931.32 from timber sales. No council property, which is totallly assessed at $196,204, will be sold. 8. New Jersey's five councils, serving 54,500 youths with assets totaling $56 million are being asked to contribute $14.2 million toward a $600 million council share of the proposed $1.9 billion national settlement. Two Pennsylvania councils that serve parts of New Jersey with total assets of $23 million are being asked to contribute another $4 million. John Lucas, the (TCC) panel's bankruptcy attorney, says New Jersey's share of the settlement alone should be closer to $44 million and with the two Pennsylvania councils should total $58 million. The seven councils serving New Jersey residents have remained uniformly silent on the settlement. Their CEOs have followed national instructions to focus on each council's "business as usual," sympathizing with abuse victims but offering little if any information on the settlement's local impact. However, councils in New York, Iowa and Arizona have begun telling their memberships what their share of the settlement will be, and how it will be financed. ... The assessments are not divided proportionally according to a state's share of the suits. Northern New Jersey Council has 525 abuse suits, or 42.5% of the state's 1,235 total claims, but is contributing only $3.06 million, or 21.6% of the total assessment for the five councils. 13. "Scouting’s largest event in the world — Jamboree-on-the-Air (JOTA) — takes place October 15 – 17. During JOTA, Scouts and hams around the world, around the nation, and in your own community meet on the air via amateur radio. Scouts of any age and sex may participate, from Cub Scouts to Boy Scouts and Venturers. The participating scouts often gather at a station made available by a volunteer, or at one set up just for JOTA. Communication typically involves SSB or FM voice, but it’s also possible that other modes, such as video or digital, will be employed — or even repeater or satellite communication." 14. IMHO nothing changed yesterday. We got Mr. Johnson's side of why he left, the rest we knew or strongly suspected. I want hard evidence of that data. At the very, very least, a release of names and contact information of the NEC and National Executive Board (as of when he left would give us a start). I am not writing Congress. I'm sticking with our own circus, I'm first writing members of the NEB. Another $0.02,
  15. IMHO, if only we had hired someone with a police background, who could not be intimidated, who knew how to investigate suspected criminal activity, collect evidence, and draw upon his contacts in local, state, and federal law enforcement organizations to make scouting safe. My $0.02,
  16. Hopefully, Mr. Johnson brings printouts of that data just as Facebook whistleblower Frances Haugen did. Another $0.02,
  17. If a professional consultant or board member's resume showed a 10 year director position where he/she had continuing unresolved issues, I imagine that consultant or board member would perform career damage control. Anyway, a possible explanation as to timing and motive. My $0.02

The BSA spent more than $150 million on settlements and legal and related professional costs from 2017 through 2019 alone. In addition to the unsustainable financial cost of continuing to engage in piecemeal litigation across the country, continuing this process will result in the risk of inconsistent judicial outcomes and inequitable treatment of victims. For these reasons, beginning in late 2018, the BSA, with assistance of legal and financial advisors, began to explore strategic options for achieving an equitable global resolution of abuse claims." 19. Found these: Michael Johnson is a member of Board of Directors of the Zero Abuse Project "Michael Johnson was the Youth Protection Advisor/Director for the National Office of the Boy Scouts of America (BSA) from July 2010 to December 2020, where he advised on efforts to improve youth protection policies, training, and procedures to ensure the safest possible environment for BSA youth. Johnson is credited with acting as a change agent to strengthen BSA’s “Youth Protection” program, and he spearheaded the BSA’s efforts to provide ongoing support to survivors and a trauma-informed response to victims of abuse in the organization." Michael Johnson is a member of the Advisory Board of the University of Washington Joshua Center on Child Sexual Abuse Prevention. "...Michael Johnson is a Prevention Consultant and Trainer. He formerly served as the Youth Protection Director for the Boy Scouts of America (BSA), where he led the organization’s efforts to continually enhance and improve youth protection policies and procedures and ensure the safest possible environment for its more than 2.3 million youth members. An internationally-recognized expert on child abuse detection and prevention, and a 28-year law enforcement veteran, Johnson oversaw youth protection for BSA from 2010 to 2020. Prior to joining BSA, Johnson served for nearly 28 years as a Detective and the Lead Child Abuse Investigator in the Juvenile Division of the Plano Police Department in Plano, Texas. ..."
  20. Sioux Council has accepted $2M offer on 223 acre Newton Hills Scout Camp from South Dakota Game, Fish and Parks. The property had been appraised at $3.59 million by the state. Somewhat unusual for the times, there is no mention of the bankruptcy or contributing to the settlement. "The Newton Hills scout camp was built during the 1930s and would require the most improvements of the Sioux Council's three scout camps to bring it up to the Boy Scouts of America standards, including a storm shelter, modernized latrines and showers for the campers... Funds from the property sale would primarily be used to build storm shelters at the two remaining camps. A wetlands project and museum of paleontology are also in the works for the Lewis and Clark scout camp." 21. Maybe. Another possibility however unlikely, Douglas Sovereign Smith, a former program director of the Boy Scouts of America and chairman of its Youth Protection Task Force. He was released from prison in 2013 after serving about 7 years on child pornography charges.
  22. No one here, except members who are claimants, have any part of deciding anything in this bankruptcy. Let's drop the personal criticism of others who express in a scoutlike way their differing opinions. Thanks, RS @gpurlee@T2Eagle @Eagle1993 @MattR@elitts
  23. Heart of New England Council (Central Massachusetts) quickly sold their headquarters and scout shop building (or one of them after council merger) for $700,000. It had been listed at $799,000. Quite a bargain for a prime property in view and directly off an exit of a major Boston commuter highway, Route 2. I see a large Mobil Mart/Dunkins/McDonalds in its future. The Council office was moved to Treasure Valley Scout Reservation in Rutland, MA Mark Barbernitz, Scout executive and CEO of Council, said the executive board is still discussing how to fill the final settlement amount, but that some of the funds from the sale would probably be used for it. ..
