If this was a properly planned winter camping trip, short of a full blown blizard there should be no reason to cancel. -
This person, I won't stoop so low as to call him a scout, lied to other good scouters and dishonored scouting and scoutings highest award. You think I am being harsh? That calling him a liar and a low life is not appropriate? I have no respect for him at all, non what so ever. On the other hand I repect people like Merlyn. He may not like scouting and disagree with a lot of what we do, but atleast he is honest and truthful upfront and does not openly try to lie and deceive us. But since he isn't man enough to answer who he is I guess there is no sense in continueing this discussion.(This message has been edited by nldscout)

While some of the others on here may be polite and want to carry on this discussion, all I want from you is your name and council, so I can see to it you sorry lieing self can be booted out of scouting forever. You obviously don't give a damn about following the rules, you have constatly lied to your leaders, and staff. So for once in your sorry life, admit that your not an Eagle scout and tell me your name.

What you should do is if you truly are an Eagle Scout is tell us what troop you are in, and where its located so we can notify your CE so he can boot your ass out of scouting.

The thing here is not to get your shorts in a bunch. If you have ever read civil complaints, they all look the same, they all alledge a ton of things initially to make sure they cover everything under the sun. I have seen a lot and they all say the same kind of things. It would be interesting to read the BSA answer to the summons and complaint. -

Where does it say he only had 1 ganola bar? It said they only found one empty wrapper. No one knows what he had eaten and then disposed of the wrappers in a trash recepticle at the place they stopped for lunch. I notice also that the parents have no qualms about accepting the posthoumous Eagle award, which by the way I have never heard of. The only thing I have ever heard was the spirit of eagle. -

If you read the whole NPS report line by line, some things don't add up. The father says his son is fit, described as 5'6, 210lbs, all muscle. That doesn't sound like an out of shape youth to me. They started hiking at 830am, and the incidint took place sometime between 5pm and 6pm. Thats 8-9 hrs, to do 20 miles thats not even stressing. Seems like they were not pushing it very hard at all. -

There has never been a leader held finacially responsible according to BSA's lawyers. They cover leaders so they can get people to volunteer. -
Don't put the hot oven down on the ice or snow. If you do you will probably be buying a new one. Cast Irom works good in the cold because it hold the heat.

By now I would hope he has spoken to an attorney, whom I would bet has told him in no uncertain term to keep his mouth shut and not talk about what happened. But human beings what they are people have in inate need to talk. You cannot believe when they are standing on the other side of the bench that they spout off about something incriminating and their attorney says SHUT UP! But nope, on they babble some more, some you can't shut up So ask yourself, Why would you want to put possibly put him in a worse situation. The time to ask is when the issue is settled.

The thing here is, we don't know what really happened. We don't know why they waited so long, it could have been that the kids were sitting in the shade drinking, the leaders thinking they were just hot, and needed an extended rest. Then he crashed, who knows. What I do know is the complaint looks like a typical civil complaint, we haven't seen the answer, which is the next step. Then there will be discovery, and depositions and conferences, and more conferences. Then the negotiations will start, and more negotiations. Then if they don't reach an agreement, they will start with written motions to the court. Motions to dismiss, motions for discovery, motions for records, motions for this and that. Then sometime in 2 or 3 years, maybe they will have a trial, doubtful, but its possible. I would not hold my breath to see what happens, cause its gonna take a long time. -

First, in reference to te court document, they are going to alledge any kind on negligence that they can think of. They have to because if they don't put it in the complaint they can't bring it up later. Second, if you read the complaint it says the temp was over 100, yet the news report says a high of 92. That 10 degree's is a big difference. This is only the first piece of paper filed, its a long way before anything is settled. Its all about money with these parents, thats all they are asking for. Lawyer, can't live with, can't live without them -
"It seems as if kids today are cut from a different cloth than we were. There has been a decline in respect, ethics, morals and good behavior in general." I for one don't beleive that is necessarilly true. I think a great portion is parents and adults not holding young people accountable for their actions. I frequently see youthful offenders, in NY 16-19, that if they have a parent with them in court that takes responsibility for their child, I generally only see them once. If the parent makes them own up to what they did and let them suffer a little. Once is usually enough. On the other hand when the parent is absent, or is part of the problem, I get to see them over and over on a variety of issues eventually earning them a place in prison a few years down the road. A lot of the time time parents are the enabler. They let the kids drink, thinking they will be friends. They say to me, well its nt Johnnie's fault everyone is always picking on him. Hold your scouts accountable for their actions even if it costs you a few in membership in the end. How would you feel if you award him his eagle and then 6 months later he gets caught drinking and driving again?

One problem we have is they way people see DUI. People don't see DUI as a serious crime. Ask your self what would you be thinking if he was arrested for Assault, or Larceny, or maybe even Sexual Misconduct! Would you even want him to be in the troop? Would you have booted or suspended him already? This is the problem with DUI, people don't take it serious.

The problem you may have is you may never know the outcome of his DUI due to his age. At 16 in most states the records are going to be sealed, so unless you ask him and he is willing to talk, you won't know. Speaking strickly about NY laws here, a 16 yr old would be a Youthful offender and his first conviction on a Misdemenour would be set aside and the record sealed. At this point I wouldn't ask him anything about it, because you may cause him future court issues if he confesses anything to you, plus like others have said, Innocent until proven guilty.

If I am following what you said everone must agree to follow the troop policy bylaws. I wouldn't see anything wrong with that.

Right now the Ice is terrible in most places, not enogh cold and too much snow. Last weekend we only had 4 inches here in Northern New York. Thats barely enough.

Like I said way back when this thread started, who owns what and what happens to it is ntirely dependent upon the state that you are located in. In several states a Boy Scout troop is an unincorporated entity that has multiple legal and ownership rights. Here in NY you have more limited ownership, But all the trailers and boats we own are registered to Troop XX. No where id the CO's name on it anywhere. This is why BSA has no hard rules on ownership because it changes state to state.

John, So if you don't have an order sheet, how do you know if she ordered, if she paid, and what she ordered?

Since you have no order sheet, if someone does come forward and say they ordered popcorn, how would you know? So in walks this person and he/she says I ordered popcorn from a scout, paid for it in cash and didn't receive it. So you ask, what did you order and how much did you pay, and who was the scout? So whats he going to say, I don't remember, I paid cash and it was a Boy Scout in uniform. What do ya do?
